Our Commercial Support covers a multitude of areas and can include assisting a company developing their own internal quality management systems, business control and growth strategies, monitoring projects for funders and banks to ensure compliance with the contractual machinery, assessing contractual risk that may affect project viability and many more.
We generally find that our clients have an outline of what they would like to achieve with a project but are uncertain of whether it can be delivered or actually how to deliver it. For public sector clients this can be particularly problematic when coupled with the requirement to comply with procurement regulations and limitations on capital funding.
The public sector are compelled to utilise open and transparent procurement routes which whilst wholly commendable can cause them some difficulties when trying to develop innovative solutions to particular project requirements.
In the past we have assisted clients by guiding them through the legislative framework to arrive at solutions that may require input from a diverse range of sources. For many achieving private sector backing and support, either through financial contribution or the ownership/management of capital assets (usually buildings or structures) is required.
Funders, commercial organisations, developers and contractors may all be interested in developing collaborative working approaches with the public sector. Private public partnerships might involve asset swaps, direct asset ownerships, build- own- operate approaches all of which can be daunting. We aim to focus our diverse knowledge of construction, legal matters, commercial organisations, negotiation and legislation to help clients achieve their goals.
In some instances we will enlist the help of large firms of Solicitors or accountancy practices to deliver specialist financial modeling solutions or employment law input. We may develop teams including designers, space planners, funders etc. to formulate a strategic approach to project delivery.
In many cases the client will not be absolutely sure of what it is they may require in a project. Whilst this may sound strange it actually relates to the gap that exists between the public sector and commercial organisations.
Our own Public Contracts Regulations 2006 provide an opportunity to narrow this gap by utilising what is known as Competitive Dialogue procedures. For complex projects that may not have a clearly defined legal structure or complex funding arrangements this provides the public sector with a mechanism for fine tuning their required project specification without falling foul of limitations on their ability to "negotiate" with potential suppliers.
In essence then our approach to "Strategy" is that it is the synthesis of a diverse set of skills and a broad knowledge base used to deliver pragmatic commercially viable options to our clients.
